Marijuana after Proposition 64; what's legal and what's not.
Proposition 64, which passed in November 2016, made possession of marijuana legal in California.Marijuana possession is legal if:
You are age 21+ and
The amount is 1 ounce or less or regular marijuana and/or 8 grams or less of concentrated marijuana.
Possession of marijuana is also never a felony (can only be a misdemeanor).
Marijuana cultivation is legal if:
You are age 21+ and
6 or fewer plants and
In locked and out of sight area
What can't you do?
Possession for sale (unless authorized by Compassionate Care Act or with a license) (misdemeanor)
Smoke or ingest in public (infraction)
Smoke where tobacco prohibited (infraction)
Smoke within 1000 feet of a school/day care when children are present (infraction)
Possess an open container of marijuana while riding a vehicle used for transportation (infraction)
