Tips for filling out form PE32

When completing form PE32, pay special attention to these less obvious sections:

Item 1

Decedent's Residence

Make sure to accurately fill in the decedent's last town of legal residence, not just where they were living at the time of death, as this affects which probate court has jurisdiction.
Item 2

Filing Deadline

Be mindful that creditors have four months from the first publication date to submit claims. The publication date is crucial in determining the deadline, so ensure this date is correct.
Item 3

Address Accuracy

Double-check the mailing address provided for the Executor/Administrator, as all claims and related communications will be sent there. Any errors can delay the process.
Item 4

Court Copy

Remember to send a copy of each claim submitted to the court as well. This step is often overlooked but is mandatory for each claim to be validated.
Item 5

Publication Details

Choose the publication carefully to ensure proper legal notice is given to potential creditors, particularly in the area where the decedent lived or conducted business.

What to do after filing form PE32

1
Verify publication of the Notice in the designated publication to ensure it reaches potential creditors.
2
Track the start date of the four-month period from the publication date for creditors to submit claims.
3
Collect and review any claims received from creditors within the four-month period.
4
Respond to each creditor claim by either accepting, negotiating, or disputing the claim as part of the estate administration process.
5
Prepare and file the necessary documentation with the Probate Court related to any creditor claims and resolutions.
